Rental Rules

RENTAL RULES 

The rental rules below are provided to allow prospective renters to review the rules and regulations associated with renting our home.  The official rental rules will be sent along with a rental agreement during the reservation process.  Please be advised that the signed rental agreement is the official document in the case of errors or differences from below.  Ultimately my goal is to ensure the rental of my home is a transparent process and as easy as possible.

 1.       CHECK-IN TIME is after 3 P.M. EST day of arrival and CHECK-OUT time is no later than 10 A.M. EST on day of departure stated on rental agreement form.  Early check-in or later check-out must be previously approved in writing by owner.  Late check-out may result in forfeiture of all or part of tenant’s security deposit.

2.       This is a NON SMOKING unit.  Smoking is not allowed anywhere on the premises, to include porch/balcony.

3.       Pets are not permitted in the rental units or on Shore Haven II property under any condition.

4.       NO FEEDING OF WILDLIFE – Geese on the property destroy landscaping.

5.       We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent.

6.       FIREWORKS AND GRILLING ON BALCONIES ARE ILLEGAL WITHIN CITY LIMITS, therefore prohibited.  Clothing, towels or linens may not be draped over outdoor furniture or balcony rails.

7.       Supplies – Our home is equipped with pillows, comforters, silverware, pots and pans, dishes, broom, mop and a vacuum cleaner.  Please bring your own linens, towels, and paper products/garbage bags.  The nearest grocery store, Boulineau’s, is located at 212 Sea Mountain Hwy.

8.       LINENS are NOT provided.  Tenant is responsible for all linens and towels.  Beds include: 1 King, 2 Queen beds & 1 full foldout sofa/sleeper.  Linen Rental is available.

9.       Locked owner’s closet is not for Tenant use.

10.    No Phone is provided.  Please plan on using a mobile phone during your visit.

11.    Swimming and/or using the Jacuzzi are permitted between the hours of 9 AM and 11 PM.  Persons using these facilities do so at their own risk.  Rules are posted at the swimming pool.  An adult must accompany all children under the age of 16.  No glass containers allowed in pool area.

12.    Parking – No golf carts, recreational vehicles, commercial vehicles, watercraft, trailers or motorcycles are allowed on premises.  There is only one designated parking spot for the condo.

13.    Noise – Loud parties will not be tolerated.  TV’s, stereos or musical instruments should be used with consideration, especially between the hours of 11 PM and 8 AM.

14.    FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

15.    MAXIMUM OCCUPANCY – The maximum number of guests per condominium is strictly limited to eight (8) guests.  Overnight guest occupancy is limited to the number of guests approved on Tenant’s signed rental agreement unless approved by owner.

16.    PAYMENT – Payment in full is due 30 days prior to arrival unless the rental period is less than 30 days from day of booking, at which point full payment will be due with the security deposit at the time of booking.

17.    Tenant must give owner immediate notice in the case of fire or other damage to the premises

18.    Owner shall not be liable for injury or damage to Tenant or any other person who uses or is on the Premises, or be liable for damage to their property.  Tenant is responsible for all acts of Tenant’s family and persons Tenant invites on the premises.

19.    Tenant may not sublet all or part of the premises, or assign this Lease or permit any other person to use the Premises.

 20.    Owner or owner’s agent may at reasonable times, enter the premises to make repairs, apply pest control, and to show to potential buyers, lenders, or tenants.  If entry to property is required, owner will notify tenant to coordinate a time no later than seven days of request for entry into home.

21.    Owner may cancel Tenant’s reservation 90 days prior to Tenant’s arrival date if the cancellation is due to a potential sale of the property.  In the case of a cancellation by the owner, Tenant will be provided a full refund of all deposits or payments paid by the Tenant to the owner.

22.    DAMAGE/RESERVATION DEPOSIT-A security deposit of $300 is required.  This must be received within 7 days of booking the reservation.  The deposit automatically converts to a security/damage deposit upon arrival.  The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met.

a.   Property is returned in the same conditon as found.  No damage is done to unit or its contents.

b.   No charges are incurred due to contraband, pets or collection of rents or services rendered

c.   No provided linens/bedding are lost or damaged.

d.   No early check-in or late check-out unless written into rental agreement

e.   The renter is not evicted by the owner, representative of the owner or the law enforcement.

f.    Condominium is cleaned and secured to include:

1.  Empty all trash cans and place debris, rubbish and discards into the dumpster.

2.  Remove all perishables from refrigerator and place in dumpster.

3.  Place all dirty dishes/utensils in dishwasher and start.

4.  Remove all bed linens and remake beds with comforters and pillows/shams

5.  Set A/C thermostat to 62 for heat(Left) and 80 for cool(right).

6.  Lock all windows and doors to include all sliding doors.(close all blinds)

23.    CANCELLATIONS – Should you need to cancel please notify us as soon as possible.  Greater than 30 days from your arrival, only your full security deposit will be forfeited.  If the cancellation occurs less than 30 days from your arrival you will forfeit the entire stay’s rental cost.  If you forfeit the entire stay’s rental cost, your security deposit will be returned.  In either case, you will be given a full refund minus a $100 cancellation fee if the unit is rerented at the full rental amount.  (Note: ACTIVE DUTY MILITARY contact owner as soon as possible if cancellation is due to unexpected orders.  If notified outside of 14 days prior to your arrival partial refund may be considered.)

24.    RATE CHANGES – Rates subject to change without notice.  Confirmed rental rates with a signed rental agreement and paid reservation deposit are excluded.

25.    WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance.

26.    Weather, Act of God, and other Events – In the event that there is a mandatory evacuation or inability to occupy the rental due to weather, act of God, fire, flood, or other events beyond the control and without the fault or negligence of the owners, the maximum liability for any claim, loss expense or damage shall in no event exceed the sums actually paid by the renter to the owner during the period of the event.  The owner will not be liable for incidental, special, consequential or indirect damages arising out of or in connection with the Rental Agreement.  No refunds for storms will be given except for the period of time that a Mandatory Evacuation by law enforcement was in effect.
